Terms of service.
1. Services Provided_
I offer a comprehensive range of services, including but not limited to:
Event Photography and Videography
Hospitality Media Creation
Social Media Content Creation and Scheduling
All deliverables will be edited files unless otherwise agreed upon. RAW files can be provided upon request, subject to an additional fee.
2. Pricing and Payment Terms_
Custom Pricing: All pricing is determined during the quoting phase, tailored to the specific needs of each project. As every story and project is unique, so is the pricing.
Structure:
Shooting time is charged on an hourly basis.
Photo editing fees are calculated based on the number of photos.
Preproduction is billed hourly.
Any required equipment rentals will be added to the quote unless an alternative agreement is made.
Quote Acceptance and Deposit: To initiate the preproduction phase, clients must confirm the quote via email and provide an upfront deposit of 30% of the total estimated cost.
Final Payment: The remaining balance is due upon delivery of the final product. For longer projects or in cases where rental costs are significant, alternative payment arrangements may be made and must be documented via email.
3. Gantt Chart and Scheduling_
Upon acceptance of the quote and receipt of the deposit, a Gantt chart will be created to establish timelines and schedule key dates. This chart will be used to manage the project's progress and ensure timely delivery.
4. Cancellation and Rescheduling_
Rescheduling: I understand that sometimes unforeseen circumstances arise that may require rescheduling. Clients are encouraged to provide as much notice as possible, ideally between 3-5 business days, to allow for adequate adjustments.
Cancellation: If a cancellation or rescheduling request is made too close to the scheduled shooting day, and/or if preproduction work has already been completed, the upfront payment of 30% will be retained.
Additional Costs: Any costs incurred for rentals, location bookings, or similar expenses included in the quote will be charged to the client, even if a discount or alternative agreement was previously arranged.
Notice Period: Depending on the project’s complexity, more notice may be required to effectively manage the rescheduling or cancellation. The specific notice period will be communicated to the client during the planning phase.
5. Intellectual Property and Usage Rights_
Client Ownership: As the client, you retain ownership of the content created during our collaboration. Once the final deliverables are handed over, you are free to use the content as you see fit, with the following considerations:
Commercial Use: If you intend to make a direct profit from the content (e.g., selling prints of photos), an additional agreement must be reached to outline the terms of such use.
Respectful Use: The content should not be used in a derogatory manner or in a way that degrades others. Credit to the creators is highly encouraged, as it reflects the mutual respect and pride in the work we have accomplished together.
Robertson.Media Usage: Robertson.Media reserves the right to use the content created for their own purposes, including but not limited to marketing, social media, and portfolio displays.
Confidentiality and NDAs: We value confidentiality and are open to signing Non-Disclosure Agreements (NDAs) if required. Communication is key, and we are always willing to discuss and agree on specific terms to ensure mutual satisfaction.
6. Delivery and Deadlines_
Project Timelines: Each project is unique, and the turnaround time may vary. To ensure clarity, a Gantt chart with an estimated timeline will be provided for each specific project.
Digital Delivery: Final files are typically delivered digitally via a cloud service. The folder containing the deliverables will remain accessible for 30 days from the date of delivery, after which it will be deleted from the server.
Additional Delivery Options: Upon request, I can provide printed copies, framed prints, booklets, and, in certain cases, the negatives of analog photographs taken during the project.
Communication and Updates: Keeping an open line of communication is crucial. I will provide regular updates on the progress of the deliverables and do my best to adhere to the agreed-upon schedule. If major delays occur, we will discuss and reach a mutually agreeable solution tailored to the specific circumstances.
7. Revisions and Edits_
Included Revisions: Each quote includes a specified number of revisions, which may vary depending on the item or service. These revisions must be submitted via email, either as a document or directly in the email body. Once a revision is submitted, it will count as one of the included revisions.
Providing Feedback: To ensure the best outcome, please provide as much detail as possible when submitting revisions. While I don’t expect you to know all the technical terms, any ideas, timestamps, screenshots, references, or other guidance you can offer will help us achieve your vision quickly and effectively.
Review Process: When the material is ready for review, take your time to thoroughly examine the content and compile your feedback. However, keep in mind that the longer you take to review, the longer it will take to finalize the project.
Additional Revisions: If further revisions are required beyond those included in the initial quote or if there is a change of plans, an additional fee will apply. This fee will be calculated as a percentage of the total quoted cost and will be clearly stated in the quote's comment section.
8. Liability and Indemnification_
Limitation of Liability: Robertson.Media ensures that all equipment and services are maintained to the highest standards to prevent any potential liabilities or issues. However, while evry person working under Robertson.Media is insured and takes full responsibility for their health and any situations within their control during the shoot, they cannot be held liable for any loss, damage, or issues beyond their control, including equipment malfunction or data loss. In the event that data recovery requires third-party services, an agreement will be reached between the parties on how to proceed.
Third-Party Responsibility: When working with third parties, Robertson.Media shall not be held liable for the health or responsibilities of those third parties. The client acknowledges that any third-party individuals involved are outside the scope of Robertson.Media's partners liability.
Equipment Damage: Should any equipment be damaged by the client or anyone associated with the client, the client will be responsible for covering the costs of repair or replacement at the same or higher value.
Client Responsibility: The client is responsible for providing accurate and timely information to support the project. Any delays or issues resulting from inaccurate information or a lack of communication will not be considered a liability of Robertson.Media.
Dangerous Activities: If any aspect of the shoot involves dangerous activities or conditions, a liability waiver will be drafted for the specific case, outlining the risks involved. This waiver must be signed by both the client and Robertson.Media prior to the commencement of the shoot. The client assumes full responsibility for any risks associated with these activities and agrees to indemnify Robertson.Media from any claims or damages arising from them.
Indemnification: The client agrees to indemnify and hold harmless Robertson.Media from any claims, damages, or expenses arising from the client’s use of the content or from any third-party claims related to the project.
9. Confidentiality and Privacy_
Privacy Commitment: Robertson.Media is committed to respecting your privacy and ensures that personal data will not be shared with any third parties.
Non-Disclosure Agreements (NDAs): If a Non-Disclosure Agreement (NDA) is required, Robertson.Media is prepared to draft or sign the NDA and uphold its terms as long as necessary to protect confidentiality.
Data Storage and Communication: Personal information is stored securely and locally. All communication should be conducted via email or messages during reasonable hours and in a respectful manner_
